CLASSIC FINE FOODS DUBAI TERMS AND CONDITIONS
The present Special Conditions of Online Sales exclusively concern the sales, without online payment, of products (non-food products, and food products) present on the website dev.classicfinefoods.market.
They govern the contractual relationship between Classic Fine Foods Dubai and Classic Fine Foods Dubai Customers wishing to make online purchases (not involving online payment) of products available on the dev.classicfinefoods.market website.
These Special Terms and Conditions of Online Sale are complementary to the General Terms and Conditions of Sale of Classic Fine Foods Dubai's Customers;
These Special Terms and Conditions are subject to change at any time by Classic Fine Foods Dubai.
1. Subject
Classic Fine Foods Dubai offers its Customers, making purchases directly related to their professional activity, an online shopping service, via the website dev.classicfinefoods.market, for non-food and food products.
Only the products available for sale on the dev.classicfinefoods.market website are subject to these Special Conditions of Online Sale.
2. Conditions of access
Any Classic Fine Foods Dubai customer, holder of a customer account with Classic Fine Foods Dubai, can benefit from this online sales service.
3. Order and order confirmation
Product orders must be placed by the Classic Fine Foods Dubai Customer online at dev.classicfinefoods.market.
In general, the Classic Fine Foods Dubai Customer is responsible for all online purchases made through their Classic Fine Foods Dubai Internet account.
An order number will be allocated to the Classic Fine Foods Dubai Customer once the order has been duly validated and payment has been accepted.
A "Your order is confirmed" message will appear on the Customer’s screen and an order confirmation will be sent to the Customer by email with the order number.
In the event that payment for the order is refused, the order will be cancelled and the Customer will be notified by e-mail.
The Customer's order is final. The Customer has no right of retraction or cancellation of the order, except with the prior explicit and exceptional agreement of Classic Fine Foods Dubai.
4. Provision and delivery of the Order
4.1 Product availability
Product offers are valid as long as they are visible on the website, within the limit of available stocks.
If some or all of the products ordered are unavailable, and/or if there is an incident relating to the order placed by the Customer, Classic Fine Foods Dubai will contact the Customer by telephone or by e-mail.
On the website, a dedicated order tracking area allows Classic Fine Foods Dubai customers to follow the progress of their order at any time.
In the event of the unavailability of all or part of the products ordered, the Classic Fine Foods Dubai Customer will be able to cancel all or part of the unavailable order, subject to prior written confirmation from Classic Fine Foods Dubai.
In any event, no modification of the order (other than in the event of unavailability of products) will be accepted unless expressly agreed in advance by Classic Fine Foods Dubai.
4.2 Method of delivery of products
Classic Fine Foods Dubai offers its Customers the following delivery and pick-up terms and conditions under the conditions below :
- delivery to the Customer's professional establishment (either to the "doorstep" of the Customer's professional establishment, i.e. on the pavement, or "inside the establishment/on the appropriate floor" in accordance with the terms and conditions set out in article 4.2.1.3 entitled "Delivery terms and conditions" if access permits).
- or" collection from the warehouse proposed at the time of the order.
4.2.1 Delivery to the Customer's business establishment
4.2.1.1 Product delivery time
The delivery time is specified on the Product Sheet at the time of order. It depends on the type of product ordered, the delivery constraints and the possible appointment booking.
It is specified that these delivery times and product availability are given as an indication. They do not constitute a firm commitment on the part of Classic Fine Foods Dubai. No compensation of any kind whatsoever may be claimed by the Client in the event of the unavailability of one or more products or a delay in the delivery of the order.
For orders comprising items that can be delivered on different dates with regard to the availability of the products ordered and/or their category (light product, heavy product, etc.), the indicated delivery time will be calculated based on the longest delivery time.
4.2.1.1 General case
The Products will be delivered to the professional establishment of the Classic Fine Foods Dubai Customer within a minimum period of time.
4.2.1.1.2. Specific cases
If the order is for products including delivery, installation and/or set up (or products with Included Services)
For products with Included Services (i.e. including delivery, installation and/or set up), a carrier will contact the Customer by telephone to arrange the day and time of delivery of the order. The delivery time is generally a minimum of 12 working days from the customer’s order email confirmation sent by Classic Fine Foods Dubai.
4.2.1.2 Delivery address for products
The delivery of the order is made to the address provided by the Customer at the time he created his Classic Fine Foods Dubai account, on his own authority.
In exceptional cases, business customers may indicate another business delivery address, such as one of their secondary establishments. In this case, the Classic Fine Foods Dubai Customer is fully responsible for any such change of delivery address and in particular for any error, anomaly, etc. due to this change of delivery address.
4.2.1.3 Terms of delivery
As a matter of principle, delivery to the professional establishment (excluding Products with Included Services) includes delivery of the products to the "doorstep", i.e. the entrance (ground floor)/basement of the Customer's professional establishment.
However, the Customer may subscribe to the additional service for paid delivery "Delivery to the floor or inside the professional establishment", provided for in Article 4.2.1.6 hereof.
Delivery is made by road transport. The place of delivery must therefore be accessible by road.
Classic Fine Foods Dubai does not accept deliveries that require special equipment (boats, vats, lifts, etc.) or abnormal handling to unload the goods.
If events beyond the control of Classic Fine Foods Dubai, such as force majeure, strikes, administrative decisions, natural events (road snow, landslides, storms...) or any other circumstances, have prevented or delayed the performance of its services, Classic Fine Foods Dubai cannot be held liable in any way. No compensation will be granted to the Client in any of these situations.
Upon delivery of the order, the Client must present to the carrier appointed by Classic Fine Foods Dubai his order summary/order confirmation including the order number and his identity card.
Upon receipt of the order, the Customer or one of his duly authorised representatives undertakes to check the goods delivered (number of products, good condition of the products, etc.), to sign and stamp the transport order and/or the accompanying document and to mention, if necessary, any reservations (damage, non-compliance with the specifications indicated on the order form, etc.). Said reservations must be confirmed by the Customer by registered letter with acknowledgement of receipt within 72 hours of delivery from the carrier and Classic Fine Foods Dubai.
In any event, in the absence of a reservation and written confirmation in the aforementioned forms and within the aforementioned time limits, the product order is deemed to have been delivered in compliance and any claim will be deemed inadmissible.
4.2.1.4 Absence of the Client upon delivery
If the Customer does not collect his order within 1 month after the carrier's attempted delivery, this will have the effect of cancelling the sale. The sums paid by the Client will then be retained by Classic Fine Foods Dubai as compensation. It must be specified that it is not possible to make partial deliveries.
4.2.1.5 Delivery costs
In addition to the price of the products, delivery charges may be invoiced to the Classic Fine Foods Dubai Customer.
These delivery charges vary according to different criteria (nature of the products ordered, volume, weight, total amount of the order, etc.).
Classic Fine Foods Dubai reserves the right to modify its delivery charges at any time. Said delivery charges will be invoiced on the basis of the rates in force at the time of the order validation by the Classic Fine Foods Dubai Customer.
4.2.2 Collection from the Warehouse
4.2.2.1 Products concerned
All products ordered on the dev.classicfinefoods.market website can be picked up at the warehouse, with the exception of :
- Products with Included Services (i.e. including delivery, installation and/or set up);
- and all products for which only one delivery method is offered.
4.2.2.3 collection period for products delivered to the warehouse
Orders will be available for collection at the warehouse chosen by the Customer within a minimum of 3 days from the date of order confirmation by Classic Fine Foods Dubai, under normal order conditions.
Exceptionally, due to transport and logistical requirements or constraints, Classic Fine Foods Dubai may be required to modify the date initially scheduled for the collection of the order and/or extend the delivery time of an order. In the event of exceptional circumstances preventing the delivery of the product to the Customer on the agreed date and/or abnormally long delivery times, the Customer will be informed by Classic Fine Foods Dubai by any means, in particular by e-mail or telephone, of the new availability date. Exceeding the deadline cannot give rise to damages, deductions or cancellation of the order by the Client.
The products ordered are made available to the Customer for a period of 15 calendar days from the send date of the email informing the Customer that his order is available at the collection warehouse chosen by the Customer.
After this period, the Customer's order will be considered as cancelled by the Customer. The sums paid by the Client upon validation of his order will be retained by Classic Fine Foods Dubai as a penalty clause.
4.2.2.4 Warehouse collection methods
The Customer is informed by Classic Fine Foods Dubai (by e-mail or telephone) of the availability of his order at the chosen collection warehouse.
When picking up at the warehouse, the Customer must imperatively present an official document with his photo and proof of his identity to avoid any risk of fraud. If the Customer designated on the order form does not collect the goods himself, the person appointed by the Customer must present the aforementioned documents, as well as a written power of attorney dated and signed by the Customer.
In the event of refusal to provide the requested documents or in the event that they do not correspond to the information provided by the Customer, the order cannot be delivered by Classic Fine Foods Dubai.
It is the Client's responsibility to check the products given to him/her (quantities, product reference(s), product packaging, apparent condition of the products, etc.) and to express any reservations on the collection form.
Refusal of the goods, in the absence of precise reservations on the collection form, is considered as an order cancellation, and the rules defined in article 4.2.2.3. entitled "collection period for products" last paragraph of these special conditions of sale apply. The Customer will then be liable for a penalty corresponding to the amount of the refused order.
It is also incumbent on the Customer to inform Classic Fine Foods Dubai of any damage (i.e. breakage, scratch(s), tear(s), deformation(s), denting, etc.) noted on the product(s), within three days, not including public holidays, following the day of the collection of the products.
After this period, in the absence of appropriate written reservations on the collection form signed at the time of the collection of the order from the Classic Fine Foods Dubai collection warehouse chosen and in the absence of a complaint made to Classic Fine Foods Dubai in the event of product damage, the Customer acknowledges having received a delivery in accordance with his order and in good condition, without this being an obstacle to the subsequent application, where applicable, of the conventional or legal guarantees.
5. Invoicing and payment
5.1 The product prices are indicated in Dirham, excluding tax. They can be consulted on the website dev.classicfinefoods.market. These are guaranteed except when subject to obvious material errors (typographical or printing errors).
METRO reserves the right to modify its prices at any time. The products will be invoiced on the basis of the prices in force at the time of order confirmation by the Classic Fine Foods Dubai Customer, and subject to availability.
In the event that a price be clearly incorrectly displayed, whatever the reason (computer virus, manual error, technical error), the order for the product concerned will be cancelled. Classic Fine Foods Dubai will inform the Customer as soon as possible. The Customer will be able, if he wishes, to reorder at the corrected and exact price.
If the Customer chooses the option Delivery to the Customer's professional establishment (article 4-2-1), the Customer will be invoiced for the total price (product price + delivery costs + additional costs possibly chosen by the Customer) mentioned in the order summary. The invoice will be given to the Customer by Classic Fine Foods Dubai upon delivery of the order to the Customer's business address.
If the Customer chooses the warehouse pickup option (article 4-2-2), the price invoiced will only be that of the product(s) (without additional delivery charges). In this case, the invoice will be given to the Customer by Classic Fine Foods Dubai when the goods are collected from the warehouse.
On receipt of payment, Classic Fine Foods Dubai will send the Customer an email confirming the order.
It is specified that if Classic Fine Foods Dubai does not receive the payment from the Customer within 7 calendar days following the order confirmation date, the order will be automatically cancelled.
Any transfer costs are payable by the Customer.
5.4 In the event of a total or partial refund of a payment made by bank transfer, the refund will be effective within a minimum period of 10 days for payments made in full.
The total or partial refund of a payment made by credit card will be effective within 96 hours for any amount less than €450 inclusive of tax and 10 days for any amount over €450 inclusive of tax.
Any payment incident will authorise Classic Fine Foods Dubai to impede the delivery of the ordered products.
In the event that, for any reason whatsoever, the debiting of sums owed by the Customer proves impossible, Classic Fine Foods Dubai will contact the Customer in order to rectify the situation. If the Client does not rectify the situation within the period agreed with Classic Fine Foods Dubai, the sale will be immediately cancelled by operation of law and the electronic purchase process will be cancelled without the Customer being able to claim any compensation.
6. Registration of bank details / Payment options
Classic Fine Foods Dubai offers its customers the possibility to register/save one or more means of payment (i.e. their bank details) in a secure manner, in order to pay for future purchases more easily and quickly on the website.
To do so, the Customer must :
- pay for his last purchase by credit card on the website. On this occasion, the Customer shall provide his bank details, i.e. the type of bank card used (Visa, Carte bleue, Mastercard), the number of the card concerned, its expiry date and the cryptogram on the back.
- Tick the acceptance box "I authorise CFF Dubai to save my financial details to avoid having to enter them when I place future orders on the dev.classicfinefoods.market website".
- and validate the payment.
Once the payment has been validated, the data relating to the credit card used will be saved. The Client's bank details are not stored by Classic Fine Foods Dubai, but on the payment service provider's secure server.
The Customer may therefore choose to pay for future purchases by credit card (Carte Bleue, VISA, Mastercard) without having to re-enter his/her bank details. It is however specified that the cryptogram will be systematically asked for again at each purchase for security reasons.
The Customer also retains, at any time, the possibility to delete the data relating to the registered bank card and/or add another bank card,
8. Claims
For any information, questions or complaints, the Classic Fine Foods Dubai customer service is at your disposal in the "Contact us" section,
In any event, if Classic Fine Foods Dubai's liability is evoked for any reason whatsoever, it will be limited to the amount of the allegedly defective goods in question. It is the Client's responsibility to take out any policy for any claim in excess of the amount so agreed. Classic Fine Foods Dubai will not accept any return or collection of goods delivered to or collected from a Classic Fine Foods Dubai warehouse unless expressly agreed otherwise in writing in advance. Classic Fine Foods Dubai would like to remind you that the sale is made between professionals and that legal provisions specific to the sale to private individuals are not applicable. Finally, any complaint concerning a purchase of products online will be time-barred within one year from the date of delivery.
9. Restrictions
9.1 Classic Fine Foods Dubai reserves the right to assess the risks inherent in all operations and to refuse to carry out the service if necessary (e.g. unpaid, abnormality of the order, any other dispute...).
9.2 Delivery is ensured by road transport. The place of delivery must therefore be accessible by road. Classic Fine Foods Dubai does not ensure deliveries that require special equipment (boats, ferry, elevator...) or abnormal handling to unload the goods.
9.3 If events beyond the control of Classic Fine Foods Dubai, such as force majeure, strikes, administrative decisions, natural events (e.g. road snow, landslides, storms etc.), or any other circumstances impede or delay the provision of services, Classic Fine Foods Dubai cannot be held liable in any case. Compensation will not be granted to the Customer in any of these situations.
10. Modifications to the terms and conditions
METRO reserves the right to terminate or modify the offers present on the website dev.classicfinefoods.market at any time without prior notice to the Customer. In case of contradiction between the present conditions and the Classic Fine Foods Dubai general terms and conditions of sale, the present conditions will prevail.
11. Termination
Classic Fine Foods Dubai reserves the right to immediately terminate the online sales services in writing in the event of any fault on the part of the Customer, in particular in the event of non-payment, repeated absences of the Customer on the day of delivery, disputes of any kind affecting the business relationship.
12. Personal data
The Client expressly agrees to the processing of his personal data by Classic Fine Foods Dubai in accordance with the conditions set out below:
12.1 Collection and use of personal data
Classic Fine Foods Dubai is responsible for processing, collecting and sorting, through computerised systems, the Customer's individual data in order to manage and improve the Classic Fine Foods Dubai-Customer relationship on the basis of market research, to manage orders and after-sales service and to notify the Customer of Classic Fine Foods Dubai's promotional operations.
The data collected is essential for these purposes and is intended for the relevant departments of Classic Fine Foods Dubai and, where applicable, its service providers and/or subcontractors.
12.2 Transfer for technical reasons
As Classic Fine Foods Dubai is part of the METRO-Group, (a group of companies operating internationally) the Customer's personal data may be transferred to the data processing centres of METRO-Group and/or its service providers, in order to achieve the purposes indicated in point 12.1.
12.3 Security and access to computerised data
Access to the Customer's data is restricted to persons authorised to carry out data processing, security and computer maintenance operations.
12.4 Right of access, updating and right of rectification of individual data.
The Customer has the right to access and rectify computerized data concerning him/her.
12.5 Cancellation of consent and right of opposition
The Customer may, at any time, revoke the authorisation granted above, and object, on legitimate grounds, to the processing of his personal data by Classic Fine Foods Dubai. He may also object to his data being used for canvassing purposes.
12.6 Contact
For any query or request for access, modification, rectification or opposition to the processing, the Customer must send his request by means of a contact form by post to the address of the warehouse to which he belongs, for the attention of the Director, accompanied by a copy of an identity document.
13. Intellectual property
All texts, comments, illustrations and images reproduced or represented on the website are strictly reserved under intellectual property rights. Any reproduction or representation of all or part of the website or of all or part of the elements on this site is strictly prohibited.
14. Archiving of orders on the internet.
Internet orders are archived on the website and are accessible via the Customer's internet account.
15. Jurisdiction and applicable law.
Any dispute arising from these terms and conditions shall, in the absence of an amicable agreement between the Parties, be brought to a judicial level exclusively before the Commercial Court of Dubai.
16. Acceptance of the conditions.
The language of the present conditions is English.
By using the online sales service and by validating an order via the website, the Customer acknowledges having read and accepted the present Special Conditions of Online Sales. The validation of his order by the Customer of Classic Fine Foods Dubai implies the acceptance of these Special Terms and Conditions of Sale.
